Probate refers to a court-supervised proceeding that distributes a deceased person’s assets to beneficiaries named in a will (testate), or, if there is no will, to the heirs at law (intestate). In other words, assets will not automatically be distributed to those who should be entitled to them. There are three basic types of probate proceedings and the appropriate type is determined by the size of the decedent’s estate.
